Terms of Service

1. Acceptance of Terms
By creating an account or using ShipOrShame (“the Service”, “we”, “our”, “us”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. We reserve the right to update these terms at any time; continued use after a change constitutes acceptance.
2. Description of the Service
ShipOrShame is an accountability platform for builders and indie hackers. Users make public shipping commitments with hard deadlines. If a commitment is not marked as shipped before the deadline, the Service automatically posts a “shame” tweet to the user's connected Twitter/X account. If the commitment is shipped on time, Pro subscribers may have their project featured on the platform with a backlink.
3. Eligibility
You must be at least 13 years of age to use ShipOrShame. By using the Service you represent that you meet this requirement. If you are using the Service on behalf of a company, you represent that you have authority to bind that company to these terms.
4. Accounts
- You are responsible for maintaining the security of your account credentials.
- You must provide accurate information when creating an account.
- One person may not maintain more than one account for the purpose of circumventing free-tier limits.
- You are responsible for all activity that occurs under your account.
- You must notify us immediately of any unauthorized use of your account.
5. Free Tier and Paid Plans
5.1 Free Tier
Free accounts may create up to 3 public commitments per rolling 30-day window regardless of their status (pending, shipped, or failed). Commitments beyond this limit require a Pro subscription.
5.2 Pro Subscription
Pro subscribers pay a recurring monthly fee (currently $9/month) for unlimited commitments, advanced reminder settings, custom reminder messages, and the ability to have one active featured project listing at a time. Pro features are active for the duration of an active subscription.
5.3 Billing & Cancellation
Subscriptions are billed through Stripe or Freemius. You may cancel at any time from your account dashboard. Cancellation takes effect at the end of the current billing period; no partial refunds are issued for unused time. We reserve the right to change pricing with 30 days' notice.
5.4 Refunds
We offer refunds at our discretion. If you believe you are owed a refund, contact us within 7 days of the charge. Refund eligibility is evaluated case by case.
6. Twitter / X Integration and Automated Tweets
By connecting your Twitter/X account you explicitly authorize ShipOrShame to post tweets on your behalf in the following circumstances:
- Shame tweet: automatically posted when a public commitment passes its deadline without being marked as shipped. The tweet will include your commitment description and may reference your deadline.
- Ship announcement: may be posted when you mark a public commitment as shipped (if this feature is enabled on your account).
You may revoke this authorization at any time by disconnecting your Twitter/X account from your dashboard. Revoking authorization does not retroactively delete tweets already posted. We are not responsible for the public reach, reactions, or consequences of any tweet posted by the Service on your behalf.
By authorizing the integration you confirm that you own or have rights to the Twitter/X account you connect and that posting automated tweets from that account does not violate Twitter/X's own terms of service.
7. User Content
You retain ownership of content you submit (commitment descriptions, project names, URLs, descriptions, profile pictures). By submitting content you grant ShipOrShame a non-exclusive, worldwide, royalty-free license to display and reproduce that content as necessary to operate the Service (e.g., showing your commitment on the leaderboard, displaying your featured project on the homepage).
You must not submit content that:
- Is false, misleading, or defamatory
- Infringes any intellectual property rights
- Is unlawful, abusive, harassing, or obscene
- Contains malware, spam, or unsolicited advertising
- Impersonates another person or entity
We reserve the right to remove any content that violates these terms or that we deem inappropriate, at our sole discretion.
8. Featured Projects
Pro subscribers who have shipped a commitment may submit one featured project listing at a time. Listings are auto-approved and displayed publicly on the ShipOrShame homepage and projects page for up to 30 days. After 30 days the listing expires and must be resubmitted. We reserve the right to reject or remove any listing that violates these terms or contains inappropriate content, illegal products, or misleading information. The backlink included in a featured listing is a promotional benefit of the Pro plan, not a permanent SEO guarantee.
9. Email Reminders
If you enable email reminders in your dashboard settings, we will send you reminder emails before your commitment deadlines using the timing you select. You may disable reminders at any time from your dashboard. Transactional emails related to your account (e.g., billing receipts) are not subject to the reminder opt-out.
10. Prohibited Conduct
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to any part of the Service or its infrastructure
- Scrape, crawl, or otherwise extract data from the Service in bulk without our written consent
- Interfere with or disrupt the integrity or performance of the Service
- Create fake commitments or manipulate the leaderboard
- Circumvent free-tier limits by creating multiple accounts
- Reverse engineer, decompile, or disassemble any part of the Service
11. Intellectual Property
All software, design, text, graphics, and other materials that make up the ShipOrShame Service (excluding user-submitted content) are the intellectual property of ShipOrShame. Nothing in these Terms grants you a license to use our trademarks, logos, or brand assets.
12. Disclaimers
THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
We are not responsible for the real-world consequences of shame tweets posted by the Service, including but not limited to reputational harm, loss of business opportunities, or social backlash. You accept this risk when you create a public commitment and connect your Twitter/X account.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHIPORSHAME SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
14. Indemnification
You agree to indemnify and hold harmless ShipOrShame and its operators from any claim, damage, or expense (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or any content you submit.
15. Termination
We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion, with or without notice. You may delete your account at any time from your account settings. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including but not limited to Sections 7, 11, 12, 13, and 14) will survive.
16. Governing Law
These Terms are governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be resolved through good-faith negotiation first. If negotiation fails, disputes shall be subject to binding arbitration or the courts of the jurisdiction in which we operate, as applicable.
17. Changes to These Terms
We may update these Terms at any time. We will post the updated Terms with a revised “Last updated” date. For material changes we will provide notice via email or a prominent notice on the platform at least 7 days before the change takes effect.
